To be eligible for legal counsel, your legal issue must be included in our policies. Most legal problems must comply with the appropriate adequacy test of the guidelines (the so-called substantive test). Our policies include different reasoning controls for different legal issues. Depending on your legal issue, the merits check requires us to consider some of the following: Victoria Legal Aid provides free advice to people with legal issues, with a focus on criminal law, family law and certain civil law issues. Some of its services are available to all Victorians, while other services are only offered to eligible individuals. Victoria Legal Aid also offers training to strengthen the community`s knowledge of legal rights and responsibilities. Victoria Legal Aid is a government-funded organization that provides financial legal aid to those who cannot afford to pay their lawyer. Legal financing is assessed on a case-by-case basis and may cover all or part of your legal fees. If you can`t afford to pay a lawyer to conduct your case, you can ask if Victoria Legal Aid will pay a lawyer to help you (which requires you to ask for a lawyer).
Victoria Legal Aid cannot provide legal advice on commercial or commercial matters, defamation, intellectual property, wage disputes, industrial accidents, wills (deceased estates) or the purchase and sale of real estate. Private lawyers must provide VLA with a tax bill for the work they perform. They can only include claims for the costs to which they are entitled. If a lawyer charges more fees than they are entitled to, VLA will return the invoice to the lawyer for amendment or pay a reduced amount. In family law matters (with the exception of provisional or final hearings) for which a lump sum fee is due, the lawyer or a lawyer must negotiate his or her fees with the lawyer. The lawyer must pay the lawyer`s fees from the corresponding lump sum paid by VLA. In order for Victoria Legal Aid (VLA) to pay your legal fees, you must complete a legal aid application form from our firm, which we will send to VLA on your behalf. If a private lawyer provides legal services to a beneficiary, he or she cannot demand, accept or accept payment for those services, except for the payment to which the lawyer is entitled under the Legal Aid Act. If you are the parent of a minor involved in proceedings before the juvenile court, you may be entitled to legal funding. Under the Legal Aid Act 1978external link, Victoria Legal Aid (VLA) sets out payment plans to be made to private lawyers who provide legal services to those supported. There may be a limit to the amount of money available to pay for your legal problem – this is called a « cost cap. » All payments listed in this section include VAT. They apply only to private lawyers who are registered for the GST. If a private lawyer is not registered for the GST, the fee must be reduced by one eleventh. « Fees » are the fees paid by lawyers for the provision of their professional legal services on behalf of their clients. In some cases, third parties are entitled to legislative funding, but this is determined on a case-by-case basis. For more information on legal aid funding, see www.legalaid.vic.gov.au. Fees do not include refund amounts. However, legal fees sometimes include attorneys` fees.
Victoria Legal Aid (VLA) pays fees directly to lawyers or lawyers who are informed by lawyers in the private sector. Your lawyer is paid directly by us and may not ask you to pay for the services provided as part of your legal assistance. If you receive an invoice from your lawyer, let us know immediately. Once an application for membership has been submitted, third parties may submit an application to Victoria Legal Aid. However, applications for membership do not guarantee legal funding, but VLA must nevertheless assess eligibility on the basis of individual merit. In some cases, clients are not eligible for legal funding from Victoria Legal Aid because of their income or ownership of assets. If you believe that your income and/or assets exceed the threshold used by Legal Aid Victoria, our office will charge you our private fees.
